Submission Terms

These Submission Terms apply when you send a track to someone through a Sendbox page — a page at thecut.music/send/… where a DJ, label or other music professional (the "recipient") collects demos and promos. The pages and the storage behind them are provided by Heftii, Inc. ("Heftii", "we", "us"). By ticking the consent box and sending a track, you agree to these terms. If you do not agree, do not send the track.
Who these terms apply to
They apply to you as a submitter. You are not a user of The Cut app and you do not create an account with us: you verify that you control the email address you enter, and that verified address is how the recipient knows who sent the track. The recipient's own use of The Cut is governed by our Terms of Service.
What you promise about the track
By sending a track you confirm that:
- You own, or control the rights to, both the recording and the composition you are sending, including any samples, stems or other material it contains.
- Everyone who performs on or appears in the track has given you permission to share it in this way.
- Sending the track to this recipient does not breach any agreement you have with anyone else, such as a label, publisher or distributor.
- The track and your message are not unlawful, abusive or misleading, and the name and email address you give are your own.
If any of this stops being true, tell us at the address below and we will remove the track.
The licence you give us
So that we can do what you are asking — deliver your track to the recipient — you give Heftii a non-exclusive, royalty-free, worldwide licence to store the file, and to stream it or make it available to the recipient and to any reviewers the recipient later adds to their Sendbox, for the purpose of the recipient reviewing it. That is the whole licence. We will not use the track for anything else, we will not distribute it publicly, and we do not claim any ownership of it. The licence ends when the file is deleted.
If you send a SoundCloud link instead of a file, we store the link and the recipient streams the track from SoundCloud; SoundCloud's own terms govern that stream.
What the recipient receives
The recipient sees the file or link, the artist and title you entered, your name, your verified email address and your message, inside The Cut app. They may listen to the track, keep notes on it, and contact you at the address you verified.
The recipient is under no obligation to listen to the track, to respond, or to accept it. Sending a track creates no agreement between you and the recipient, and no agreement between you and Heftii beyond these terms.
How long the track is kept
Sendbox is a review inbox, not an archive. Files are kept for a limited time, which depends on the recipient's plan and on what they decide about the track:
- Free — unreviewed tracks 30 days, accepted tracks 30 days, rejected tracks 3 days.
- Pro — unreviewed tracks 90 days, accepted tracks 180 days, rejected tracks 7 days.
- Label — unreviewed tracks 180 days, accepted tracks 365 days, rejected tracks 7 days.
The unreviewed window counts from the day you send the track; the accepted and rejected windows count from the day the recipient decides. The recipient can delete a track at any time, sooner than any of these. When a recipient has not used The Cut for 45 days, their Sendbox page stops accepting new tracks until they are back.
Keep your own copy of anything you send. We do not offer a way to retrieve a track once it has been deleted.
Your personal data
To deliver and confirm the track we handle your name, your verified email address, your message and the file or link, and we send you a confirmation email. How we handle that data, who processes it for us, how long it is kept and how to ask for it to be deleted are set out in the Sendbox submissions section of our Privacy Policy.
What we may remove
We may remove a track or a message that we believe infringes someone's rights, is unlawful, or is abusive, and we may refuse further submissions from an email address that sends such material. We may also pause a Sendbox page. Where we can, we will tell the recipient why a track was removed.

No warranty
The Sendbox pages and the storage behind them are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not promise that a page will be available when you want to use it, that an upload will succeed, or that a recipient will receive, listen to or respond to your track.
Limitation of liability
To the maximum extent permitted by applicable law, Heftii, Inc. and its officers, employees, contractors and affiliates are not liable to you or to any third party for any damages arising out of or related to sending a track through a Sendbox, including loss of the track, its data or any opportunity connected with it, whether based on contract, tort (including negligence), strict liability or any other legal theory. You are responsible for what you send and for any consequences of sending it. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.
Changes to these terms
We may update these Submission Terms from time to time. When we do, we will revise the "Last updated" date above; the version shown on the page when you send a track is the one that applies to that track.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles, and any dispute arising out of them will be resolved in the state or federal courts located in Delaware.
